  • Recovery for Manhattan Pedestrian
    Daniel Flanzig obtained a $3.25 Million dollar recovery for a 35 year old pedestrian struck by a turning vehicle in Manhattan. Our client was crossing 1st Ave in Midtown Manhattan, in a crosswalk, when she was struck by the Defendant who failed to see her. Although the client had no recollection of the crash due to her injuries, and the Defendant claimed she was crossing outside the cross-walk,  our investigation, including interviews with witnesses and responding officers determined that our client was in the cross-walk with the light in her favor and with the exclusive right of way.  As a result of the impact, our client sustained severe injuries including pelvic fracture, wrist fracture, rib fractures, and spinal fractures requiring her to undergo multi-level spinal fusion.  After depositions were completed and the case was placed onto the trial calendar, the case was settled via mediation.
  • Recovery for Victim of Vespa Crash
    Cathy Flanzig obtained a $2,900,000 Million dollar settlement for the victim of a serious Vespa Scotter crash in Nassau County, NY. Our client was operating his scooter when a vehicle made a sudden left turn in front of him. As a result of the crash our client sustained severe thoracic injuries. The settlement, which netted a total payout of over $ 3 Million Dollars, was reached just prior to the start of the trial in the New York State Supreme Court, Nassau County.
  • Recovery for Doctor's Failure to Properly Diagnose and Treat Breast Cancer
    Flanzig and Flanzig obtained a $2,000,000.00 settlement on the fifth day of trial in a medical malpractice action. The claim was based upon the doctor's failure to properly diagnose and treat our client's breast cancer. The failure to timely diagnose the patient significantly reduced the ability to successfully treat and cure the cancer. The settlement was reached during the trial, after the trial Judge determined that the defendant physician committed medical malpractice as "a matter of law."
  • Recovery for Victim of September 11th Attack at the World Trade Center
    Daniel Flanzig obtained the above result for the family of a rescue worker killed on September 11th in World Trade Center attack. As a member of the Trial Lawyers Care program, Flanzig and Flanzig volunteered its efforts to represent the victim pro bono. More than 1,000 members of the Association of Trial Lawyers of America have volunteered to help the families of victims of the Sept. 11th. It is the largest pro bono effort their profession has ever undertaken.
  • Recovery for a 33 year Old Construction Laborer Injured in Work Site Accident
    Daniel Flanzig obtained a settlement of $1,214,844.00 for a 33 year old construction laborer who was struck by falling construction debris. The case was one of first impression for the Supreme Court, who held the owner of the property strictly liable for the accident based upon a violation of the N.Y.S. Industrial Code pertaining to the removal of concrete forms. Our client sustained a sustained a back injury which required him to undergo a lumbar fusion.
  • $4.8 Million Settlement for family of 29 Year Old Manhattan Cyclist

    Flanzig and Flanzig has obtained a $4,800,000.00 settlement on behalf of the family of a 29 year old Manhattan cyclist killed in the Bronx.

    The death of Heather Lough received wide publicity following the tragic day in 2016 when Heather was struck by a commercial truck that ultimately led to her death. Shortly thereafter, the driver was criminally charged with multiple violations of the Vehicle and Traffic Law including NYC’s “right of way” law Section 19-190. After every attempt by the driver to escape criminal liability, including a challenge to the constitutionality of NYC’s right of way law (19-190), the

    Defendant ultimately plead guilty to the charges resulting in payment of a fine and suspension of his license. Using this plea, together with the evidence obtained by the Collision Investigation Squad, our own independent investigation, and the deposition testimony of parties, Cathy Flanzig, Esq. obtained the pre-trial granting of Summary Judgement against the owner of the trucking company and its driver. With liability being established, the case was ultimately settled prior to trial via private mediation between our office and the insurance carrier for the trucking company in the amount of $4,800,000.00.

  • Recovery for a 52 year old TSA worker who suffered a fall at LGA Airport
    Daniel Flanzig obtained a $1.15 Millon Dollar settlement for a TSA worker who slipped and fell in an American Airlines Terminal at Laguardia Airport as a result of a leaking roof. This case involved highly complex medical issues including claims of R.S.D. also known as Complex Regional Pain Syndrome. The cases was ultimately settled just prior to trial in the Eastern District of the United States Federal Court.
  • Million Settlement for a Self Employed 57 Year Old Who was Struck by a Vehicle While In His Driveway
    Cathy Flanzig obtained a $1.1 Million recovery for a 56 year old man who suffered a severe leg injury requiring him to undergo several limb salvage surgeries as a result of being struck by his children's religious school teacher while in his own driveway. The settlement was reached soon after the action was commenced and the $1.1, million recovery represented the defendant's full policy limits. This case was reported in the New York Law Journal and the New York Jury Verdict Reporter as a 'Top 25 Verdict or Settlement' for a pedestrian accident in 2010.
  • Recovery for Injured EMT/First Responder for Injuries Sustained in a Fall at a Local Area Hospital
    We obtained a $1,000,000 settlement for a Suffolk County EMT/First Responder who slipped an fell on the ice outside the emergency room at an area hospital sustaining a severe injury to his back. After defeating the Defendant's motion to dismiss in the lower Court, a decision that was then affirmed in the Appellate Division, the matter was settled prior to trial in the Supreme Court, Suffolk County.
